Acceptance of These Terms
These Terms of Service (“Terms”) govern your access to and use of the website located at
enhancepros.com (the “Site”), including any content, functionality, estimate tools,
forms, and online scheduling features made available through the Site (collectively, the “Services”).
The Site is operated by Enhance Pros (“Enhance Pros,” “we,”

By accessing or using the Site or Services, you agree to be bound by these Terms and our Privacy Policy (the
“Privacy Policy”), which is incorporated by reference. If you do not agree, do not use the Site.
Changes to the Terms or Services
We may update these Terms from time to time. The “Last Updated” date at the top will change when we do. Your continued
use of the Site after changes become effective constitutes acceptance of the revised Terms.
We may modify, suspend, or discontinue any part of the Site or Services at any time.
Eligibility
You must be at least 18 years old and able to form a legally binding contract to use the Site. If you
use the Site on behalf of an entity, you represent that you have authority to bind that entity.
What the Site Provides (Information vs. Contracted Work)
The Site may provide general information about home improvement services (including bathrooms, windows, doors, roofing,
siding, gutters, and custom home improvements), and may provide tools to request estimates or obtain online/virtual
estimate outputs, including instant or automated pricing tools. The Site may also allow appointment requests and
contact form submissions.
Important: Any estimate, instant price, or scheduling confirmation made available through the Site is
not a final offer and not a binding contract for construction services. Final scope,
pricing, timeline, and terms are set only in a separate written agreement signed by you and Enhance Pros (a
“Project Agreement”).
Instant Pricing and Virtual Estimates (Online Estimate Tools)
If the Site or linked tools provide instant pricing or virtual estimates (including address-based or satellite/remote
measurement tools), you understand and agree:
- Estimates are informational and conditional. They are based on the inputs you provide and/or
third-party data sources and assumptions. - Not final pricing. Actual pricing may change based on a site inspection, verified measurements,
product selection and availability, code requirements, permitting, structural conditions, access limitations,
tear-off/repair needs, prior workmanship, weather impacts, and other factors. - Accuracy depends on your inputs. You are responsible for ensuring all information you submit is
accurate and complete (for example, property address, project type, photos, dimensions, and preferences). - We may require a site visit. We may decline to proceed without an on-site evaluation (or a more
detailed virtual consult). - No reliance for emergencies. Estimate tools are not intended for emergency situations (for example,
active roof leaks). If you have an urgent condition, call us directly.
Materials-Only Purchases (If Offered)
If we offer an option to purchase certain materials without installation (for example, “windows and doors only”), that
purchase, if available, may be governed by separate written sales terms, including delivery, handling, storage,
manufacturer warranty terms, and return policies.
Unless explicitly stated in writing, Enhance Pros is not responsible for installation, measurement verification, or
jobsite conditions for materials-only transactions.
Scheduling, Communications, and Customer Responsibilities
When you request an estimate or appointment, you agree to provide accurate contact information and property details.
You agree to provide safe and reasonable access to the property if an in-person inspection is needed, and to notify us
promptly about hazards (including mold, asbestos, electrical hazards, or structural issues).
We may reschedule due to weather, safety, staffing, permitting delays, or other circumstances.
Financing and Third-Party Providers
If the Site references financing options or links to financing providers, you understand that financing is offered by
third-party lenders, not by Enhance Pros. All credit decisions, rates, terms, and disclosures are determined by the
lender and your agreements with that lender. Enhance Pros is not responsible for lender decisions, underwriting, fees,
or disputes relating to financing.
Any lender portal or lender website is subject to that provider’s terms and privacy practices.
Promotions, Coupons, and Special Offers
Promotions (including seasonal offers) may have separate terms, eligibility requirements, minimum purchase thresholds,
expiration dates, and exclusions. Offers are void where prohibited and cannot be combined unless expressly stated.
Warranty Information (High-Level)
The Site may reference warranties (including “lifetime” or manufacturer warranties). Any warranty coverage depends on
the specific product, manufacturer terms, and the Project Agreement. Warranties may have exclusions (for example,
improper maintenance, abuse, acts of God, pre-existing conditions, unauthorized modifications, or non-covered
components). Only the written warranty documents and Project Agreement control.
Permits, Code Compliance, and Unforeseen Conditions
Where applicable, work may require permits and compliance with local or state building codes. Permit costs, inspection
timelines, and code-mandated upgrades may affect schedule and price and will be addressed in the Project Agreement.
Existing conditions (including hidden rot, water intrusion, structural defects, mold, pest damage, or prior non-code
work) may require change orders or additional work not included in an initial estimate.
User Content and Submissions
If you submit content (including photos, reviews, messages, or project details), you represent that you have the right
to submit it and that it does not infringe third-party rights.
You grant Enhance Pros a non-exclusive, worldwide, royalty-free license to use the content to provide Services and for
business purposes (for example, responding to your inquiry, quality assurance, and marketing), unless you request
otherwise in writing.
Do not submit confidential or sensitive information you do not want used or stored.
Acceptable Use
You agree not to:
- Use the Site for unlawful purposes.
- Attempt to gain unauthorized access to systems or accounts.
- Interfere with Site operation, security, or other users.
- Upload malware or harmful code.
- Scrape, copy, or harvest data without permission.
We may suspend or block access for violations.
Intellectual Property
The Site, including text, graphics, logos, images, videos, software, and tools, is owned by or licensed to Enhance
Pros and is protected by intellectual property laws. You may view and use the Site for personal, non-commercial
purposes only. No rights are granted except as expressly stated.
Third-Party Links and Tools
The Site may link to or integrate third-party services (including estimate tools hosted on other domains, financing
portals, and scheduling tools). We do not control third-party sites and are not responsible for their content,
availability, or practices. Your use of third-party services is at your own risk and subject to their terms.
Privacy
Our collection and use of personal information is described in our Privacy Policy. Where required by law, we will
obtain consent for certain processing activities.
Consent to Contact (Calls, Texts, Email)
By submitting a form, requesting an estimate, scheduling, or otherwise providing your contact information, you consent
to being contacted by Enhance Pros at the phone number(s) and email you provide, including via phone calls, SMS/text
messages, and email.
Message and data rates may apply. You can opt out of marketing texts by replying STOP (or using another
method we provide) and opt out of marketing emails via the unsubscribe link.
No purchase required: Your consent to receive marketing communications is not a condition of purchase.
We may still contact you for transactional or operational reasons (for example, appointment confirmations, project
updates, and warranty service).
Terms of Service
Carriers are not liable for delayed or undelivered messages.
PRESTIGE CONSTRUCTION WNY, LLC Doing Business As Enhance Pros uses SMS messaging to send opted-in users project estimates, appointment confirmations, service updates, and occasional promotional offers regarding our home improvement services.
Disclaimers
THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, ENHANCE PROS
DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY,
FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses. We do not warrant that
any estimate or instant pricing output will match final contract pricing.
Some jurisdictions do not allow certain disclaimers; in that case, disclaimers apply to the maximum extent permitted.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ENHANCE PROS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL,
SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR
RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SITE OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ENHANCE PROS’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE
SITE OR SERVICES WILL NOT EXCEED $100 OR THE AMOUNT YOU PAID (IF ANY) TO ACCESS THE SITE (WHICHEVER IS
GREATER).
This limitation does not apply to liability that cannot be excluded by law.
Indemnification
You agree to defend, indemnify, and hold harmless Enhance Pros and its owners, employees, contractors, and agents from
and against any claims, damages, liabilities, and expenses (including attorneys’ fees) arising from your misuse of the
Site, your violation of these Terms, your infringement of any third-party rights, or your content submissions.
Dispute Resolution; Governing Law; Venue
These Terms are governed by the laws of the State of New York, without regard to conflict of laws
rules.
Any dispute arising out of or relating to these Terms or the Site shall be brought in the state or federal courts
located in Erie County, New York, and you consent to personal jurisdiction there.
Termination
We may terminate or restrict access to the Site at any time for any reason, including suspected violations of these
Terms.
Miscellaneous
- Severability: If any provision is found unenforceable, the remainder remains in effect.
- No waiver: Failure to enforce a provision is not a waiver.
- Entire agreement: These Terms (and the Privacy Policy) are the entire agreement regarding Site use.
